Summary of FTC "Red Flag" Regulations

o Earlier this year, the FTC issued regulations addressing Red Flags, Card Issuers and Address Discrepancies.
o The Card Issuer regulations clearly are not relevant to background screening.
o The Red Flag rules likely also will have minimal or no impact on employers who utilize Sterling for background screening. Regardless, the FTC has delayed the enforcement of the new Red Flag Rules until May 1, 2009.
o The Address Discrepancy Rules are effective on November 1, 2008. However, these rules also appear generally inapplicable to background screening.
o First, the rules only are applicable if a "Notice of Address Discrepancy" is received from a nationwide consumer reporting agency. Practically, this means that the rules are only potentially applicable if credit reports are obtained. If credit reports are not obtained, there are no potential compliance issues.
